1. Who we are

2. What the service does

Scontino automatically searches for deals on Amazon, builds the affiliate links with your Amazon Associates account and publishes them on the Telegram channel or group you connect. The site scontino.com presents the service; the day-to-day work happens in the application at app.scontino.com.

The service is provided with the features available when you activate it. We may add, change or remove features: if a change materially reduces what you paid for, we will tell you beforehand and you can cancel with no penalty.

3. Who can use it

To activate a plan all of the following must be true:

• you are at least 18 and legally able to enter into a contract;
• you have an active Amazon Associates account in good standing: the links use your affiliate tag and the earnings stay yours;
• you are an administrator of the Telegram channel or group you publish to, with the permissions required;
• you provide true, up-to-date details when you sign up.

You are responsible for whatever happens through your credentials: if you suspect unauthorised access, tell us straight away.

4. Plans, prices and payments

The plans available and their prices are the ones published on the site at the time of purchase.

• Prices are in euro and, for customers subject to VAT, are exclusive of the tax due by law.
• The subscription renews automatically at the end of each monthly or yearly term until you cancel, and is charged to the payment method on file.
• Payments are handled by Stripe: we do not store your card details.
• You can cancel at any time from the application. Cancellation takes effect at the end of the period you already paid for, which stays usable; unused parts of a period are not refunded, except where the law says otherwise.
• If a payment fails we may suspend the service, after telling you and giving you a reasonable time to sort it out.
• We may change prices with at least 30 days' notice. The new price applies from the next renewal: if you do not accept it you can cancel before it takes effect.

5. Right of withdrawal for consumers

If you buy as a consumer, that is for purposes outside your business or profession, you have 14 days to withdraw without giving a reason: just write to support@scontino.com.

If you ask us to start the service straight away and you use it during those 14 days, you owe us the share of the price matching what you used; if the service has been fully performed with your express consent, the right of withdrawal is exhausted, as set out in Article 57 of the Italian Consumer Code.

6. How you must use the service

Some things you cannot do, because they put you, us and other users at risk. In particular you may not:

• publish unlawful, misleading or offensive content, or content that infringes anyone else's rights;
• use the service to send unsolicited messages to people who did not choose to receive them;
• state fake discounts or prices, or alter the product information the service generates;
• work around your plan limits, bulk-extract the service data or resell it to third parties without a written agreement with us;
• try to reach parts of the system that are not yours to reach, or interfere with how it works.

You are responsible for the content published on your channel and for complying with Amazon and Telegram rules.

7. Relationship with Amazon and Telegram

Scontino is an independent service: it is not affiliated with, sponsored or endorsed by Amazon or Telegram. Amazon, Amazon Associates and related marks belong to Amazon.com, Inc. or its affiliates; Telegram is a trademark of Telegram FZ-LLC.

By using Scontino you undertake to comply with the Amazon Associates Operating Agreement and the Telegram guidelines, including the duty to disclose on your channel that the links are affiliate links. Amazon may suspend or close your associate account for reasons outside our control: in that case the service cannot generate valid links and we are not liable for it.

8. Service availability

We work to keep the service up at all times, but we cannot guarantee it will be free of interruptions or errors. We may suspend it for maintenance, giving notice when it is planned.

Deals, prices and availability come from Amazon: they can change or run out at any moment and we do not guarantee their accuracy.

9. Intellectual property

The software, the Scontino name, the logo, the site copy and the graphics are ours or licensed to us. Your subscription gives you the right to use the service, not to copy, modify, decompile or resell it.

The content you publish stays yours: you only authorise us to process it as far as we need to run the service.

10. Liability

We are liable for damage caused by our wilful misconduct or gross negligence and, as far as the law allows, for foreseeable damage connected to the service. We are not liable for lost earnings, for affiliate commissions Amazon does not credit, for the closure of your Amazon or Telegram account, or for damage arising from a use of the service that breaches these terms.

Nothing in this section limits the mandatory rights the law gives consumers.

11. Suspension and closure

You can close your account whenever you want from the application. We may suspend or close the account if you breach these terms, if your use puts the service or other users at risk, or if the law requires it: unless it is urgent, we will tell you first and give you a chance to put it right.

On closure we stop publishing and delete your data within the timeframes set out in the Privacy Policy.

12. Changes to these terms

We may update these terms. Significant changes are notified to you with at least 30 days' notice by email or in the application and take effect from the next renewal. If you do not accept them you can cancel before they take effect.

13. Governing law and disputes

These terms are governed by Italian law. If you are a consumer, the court of the place where you reside or are domiciled remains competent and you can use the out-of-court dispute resolution procedures provided by the Italian Consumer Code. In all other cases the courts of Rimini have exclusive jurisdiction.
